HOLMDEL, NJ — July 7, 2009 — Index Engines, providers of the fastest enterprise discovery technology on the market, today announced support for California’s new law, Chapter 5, Statutes of 2009, which requires responsible parties to produce data stored in disaster recovery systems when it is relevant to litigation. Governor Schwarzenegger signed Assembly Bill 5 (AB 5) into law on June 29, 2009, and changed the way any enterprise doing business in California will think about eDiscovery going forward. Index Engines technology, allows the fast, easy, and thorough search and collection of data contained on backup tapes, the most common format of disaster recovery data. With Index Engines, the costly restoration of disaster recovery data is no longer necessary to comply with California’s new eDiscovery law.
“FRCP started the ball rolling by mandating that electronic evidence be made discoverable, but it was tempered by Zubulake’s ruling around undue burden associated electronic discovery,” said Jim McGann, VP of Marketing for Index Engines. “By making AB 5 the law, California is taking a much harder line regarding stored data which effectively nullifies Zubulake. Disaster recovery data will now be presumed fair game for discovery, and Index Engines technology makes this data easily accessible.”
Index Engines is the only solution available that can automatically catalog, index and extract data directly from tape, and other common backup containers, with out the backup software. Using Index Engines, backup data is directly indexed and the data is immediately searchable. Users can quickly find what they need, restoring only relevant files and email, rather than restoring the entire tape contents, indexing the data, and then commencing the search process. No other solution can directly index backup data allowing for full text and metadata search. Index Engines directly indexes offline tapes, as well and disk-based backup and VTLs (virtual tape libraries). The unmatched capabilities of this technology limit the time and cost associated with disaster recovery data discovery efforts that have historically needed to restore large amounts of unwanted data to access case specific information.
Index Engines is now taking orders, delivery scheduled within two weeks. Price and availability are dependant on configuration.
